Welcome to 28share.jp (the “Platform”)! We’re a job board designed to connect job seekers and employers for opportunities in domestic help, tutoring, and related services. These Terms of Service (“ToS”) outline the rules for using our website, mobile app, and related services (together, the “Services”), including creating and managing job listings. By accessing or using our Services, you agree to these ToS. If you don’t agree, please do not use the Platform.
1. Definitions
To make things clear, here are some key terms we’ll be using:
- Platform: Refers to our website (28share.jp) and mobile app.
- User: Any individual or entity using our Services, including both Job Seekers and Employers.
- Job Seeker: An individual who uses the Platform to search for or apply to job opportunities.
- Employer: An individual or entity who posts job listings or searches for candidates on the Platform.
- Job Listing: Any job posting or advertisement created by an Employer on the Platform.
- Content: All text, images, data, resumes, job listings, and any other materials submitted to or generated by the Platform.
2. Acceptance of Terms
By registering, accessing, or using our Services, you confirm that:
- You are at least 18 years old (or the legal age of majority in your jurisdiction).
- You agree to be bound by these ToS.
- If you are representing an organization (like an Employer), you confirm you have the authority to bind that organization to these ToS.
We may update these ToS from time to time. Your continued use of the Services after any updates means you accept the revised terms. We’ll always post the latest ToS with the effective date at [28share.jp].
3. Using the Platform
3.1 Eligibility & Your Account
The Platform is for Job Seekers looking for legitimate employment and Employers posting genuine job opportunities.
- You must provide accurate, current, and complete information when you register and keep it updated.
- You are responsible for all activities that occur under your account.
- Do not share your login credentials without our prior written permission.
3.2 Prohibited Activities
To ensure a safe and effective environment, Users agree not to:
- Post or transmit false, misleading, defamatory, obscene, or illegal content.
- Create job listings for non-bona fide opportunities, such as pyramid schemes, franchises, or opportunities that require upfront payments from applicants.
- Violate anyone’s intellectual property rights, including copyrights or trademarks, without proper permission.
- Use the Platform for spamming, harassment, or illegal activities (e.g., software infringement, gambling).
- Attempt to access, modify, or delete other users’ content or Platform data without authorization.
- Misrepresent your qualifications, job details, or affiliations.
3.3 Account Security
- You are responsible for maintaining the confidentiality of your password.
- Notify us immediately at info@wonderlust.plus if you suspect any unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that violate these ToS or applicable laws.
4. Job Listings
4.1 Employer Responsibilities
Employers must:
- Post accurate, lawful job listings for genuine employment opportunities.
- Ensure each listing corresponds to one specific position and clearly disclose the job type (e.g., full-time, part-time, freelance) and conditions (e.g., commission-based).
- Grant 28share.jp a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your job listings and related content (like company logos) on the Platform and our affiliated sites.
- Be solely responsible for verifying candidate suitability, obtaining necessary work permits, and complying with all local labor laws (e.g., Japan’s Labor Standards Act).
4.2 Job Seeker Responsibilities
- Job Seekers must submit accurate resumes, contact information, and application materials.
- Your applications may be shared with Employers via the Platform or you may be redirected to third-party sites, as specified in the listing.
- You acknowledge that 28share.jp does not control third-party websites linked from job listings, and you should review their terms and privacy policies separately.
4.3 Listing Review and Removal
While we don’t guarantee the inclusion or visibility of any job listing, we do reserve the right (but not the obligation) to review, edit, or remove job listings that violate these ToS, are inaccurate, or are otherwise deemed inappropriate.
5. Intellectual Property
- Platform Content: All content on the Platform, including its design, code, logos, and text, is owned by 28share.jp or our licensors and is protected by copyright and trademark laws.
- User Content: You retain ownership of your own content (e.g., resumes, job listings). However, you grant 28share.jp a non-exclusive, worldwide, royalty-free license to use, store, and display your content to provide the Services.
- You must not post content that infringes on anyone else’s intellectual property rights.
6. Privacy and Data Use
Your use of the Platform is also governed by our Privacy Policy ([28share.jp/privacy]), which explains how we collect, use, and protect your data.
- We may collect and use aggregated, anonymized data (e.g., job application trends) for analytics and to improve our Services, provided it does not identify individual users.
- Both Employers and Job Seekers consent to their data (e.g., resumes, job listings) being shared with relevant parties (e.g., Employers for applications) as part of the Services.
7. Fees and Payments
- Job Seekers: Searching and applying for jobs is generally free, unless otherwise specified.
- Employers: Posting job listings may involve fees, which will be outlined during the posting process or in a separate agreement. Fees are generally non-refundable once a listing is posted, except within 30 days if the listing wasn’t posted due to our error.
- Employers must provide accurate billing information and pay invoices within 14 days.
- We reserve the right to suspend listings or accounts for non-payment.
8. Third-Party Links
The Platform may include links to third-party websites (e.g., Employer application portals). We are not responsible for the content, accuracy, or practices of these external sites. You access third-party sites at your own risk and should review their terms and privacy policies.
9. Limitation of Liability
The Platform is provided “as is” without any warranties, express or implied.
28share.jp is not responsible for:
- The accuracy, legality, or quality of job listings or any user-generated content.
- The ability of Employers to offer jobs or Job Seekers to fill positions.
- Any damages (e.g., lost profits, data loss) that may arise from your use of the Services, to the fullest extent permitted by law.
Our liability for any claim is limited to the amount you paid us for the Services in the preceding 12 months.
10. Indemnification
You agree to indemnify and hold harmless 28share.jp, its officers, and employees from any claims, damages, or losses (including legal fees) that arise from your use of the Services, your violation of these ToS, or your infringement of any third-party rights.
11. Termination
- We may suspend or terminate your access to the Services if you violate these ToS, applicable laws, or at our discretion.
- You may terminate your account by contacting info@wonderlust.plus. We may retain some account data as outlined in our Privacy Policy.
- Upon termination, all licenses granted to you cease, but certain legal obligations from these ToS (like indemnification) will still apply.
12. Governing Law and Jurisdiction
These ToS are governed by the laws of Japan, without regard to its conflict of law principles. Any disputes will be resolved exclusively in the courts of Tokyo, Japan.
